The Court of Appeal held that, although section 35 of the Arbitration Act does not expressly provide for a right of appeal, the Supreme Court in the Nyutu decision established that the Court of Appeal has residual jurisdiction to hear appeals from High Court decisions under section 35 in exceptional circumstances. In this case, the applicant's motion to set aside the arbitral award was struck out on grounds of being filed out of time, without a hearing on the merits, thereby potentially shutting the applicant out from substantive justice. The Court found that the interpretation of section 35(3) regarding when time starts to run for receipt of the award is a jurisprudential issue...
