The appeal succeeded on the ground that the suit in the trial court was statute barred under Section 29 of the Limitation of Actions Act. The accident occurred on 9 January 2010, the deceased died on 31 January 2010, and the suit was filed on 10 January 2013, well outside the twelve-month limitation period. There was no evidence that the respondents sought or obtained leave to file the suit out of time as required by law. Consequently, the suit was not properly before the court and should have been dismissed for being time barred.
