The court found that while there was evidence suggesting awareness of the distress proceedings by at least some tenants, it was not satisfied that all affected tenants were afforded a meaningful opportunity to participate before the police-assisted distress orders were issued. Given the seriousness of the orders and the need to hear the parties inter partes, the court partially allowed the motion, kept the impugned orders set aside pending hearing, and preserved the status quo so the underlying disputes could be determined on merits.
