The High Court found that the trial magistrate correctly held the appellant 100% liable for the accident, as the appellant failed to provide sufficient evidence to rebut the presumption of liability for rear-end collisions. However, the court determined that the award of general damages was excessive given the nature of the respondent's soft tissue injuries, which were less severe than those in comparable cases. The court also found that only Kshs. 6,500 in special damages was proved by receipt, not the Kshs. 9,050 awarded by the trial court. Consequently, the court set aside the awards of general and special damages and substituted them with Kshs. 250,000 and Kshs. 6,500 respectively....
