The High Court found that at the time the petition for Letters of Administration was filed in the lower court, the pecuniary jurisdiction of magistrates' courts under Section 48 of the Law of Succession Act was limited to estates valued at Kshs.100,000/-. The petition indicated the estate was valued at Kshs.300,000/-, which was beyond the lower court's jurisdiction. As jurisdiction is conferred by law and is fundamental to the validity of court proceedings, any orders or grants issued without jurisdiction are null and void. The court further held that Section 76 of the Law of Succession Act allows any interested party, including the original petitioner, to seek revocation of a grant....
