The transfer of the suit property from Mwaniki to Kihanya Gichuri was effected through fraudulent misrepresentation to the Land Registrar, as Kihanya falsely claimed to be the same person as Mwaniki. Since Mwaniki was deceased at the time of the transfer, the only lawful means for Kihanya to acquire the property was through a succession process and grant of letters of administration, which was not done. The subsequent subdivision and transfer of the land to the defendants was therefore null and void, as Kihanya had no valid title to pass. The court declared...
