The High Court determined that it lacked jurisdiction to hear and determine the appeal and application arising from the decision of the Business Premises Rent Tribunal. Section 15 of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act (CAP 301) expressly provides that appeals from the Tribunal are to be instituted before the Environment and Land Court.
