The transfer order made on 22 September 2021 had partly been overtaken by events because Meru CMC Civil Case No 172 of 2018 had already been withdrawn by written consent and was no longer pending. Only the two live matters between the parties remained for hearing, namely Meru ELC Case No 42 of 2019 and Meru ELC No E004 of 2026, formerly Meru CMC E & L Case No 189 of 2018. The withdrawn file had to be returned to the magistrate’s registry.

Orders
