Ratio Decidendi

The court held that, although the applicant claimed she was denied a fair hearing by the Dispute Resolution Committee, the Committee's records showed her complaint was listed and considered. The Committee dismissed her complaint for lack of evidence and because the 3rd respondent ranked higher on the party list. More importantly, the court found that once the 3rd respondent was gazetted as a member of the County Assembly, any challenge to her membership could only be made through an election petition as mandated by Article 105 of the Constitution and the Elections Act. Judicial review was not the appropriate forum for such a challenge post-gazettement. The court therefore dismissed the...
