Ratio Decidendi

The court found that the original land parcel Butsotso/Shikoti/13352 had been subdivided into Butsotso/Shikoti/16462 and 16463 before the suit was filed, and thus did not exist at the time of filing. No evidence was provided as to the ownership of the new parcels. As a result, the decree issued on 22nd November, 2018 could not be enforced against a non-existent property. The court held that it could not arbitrarily order cancellation of the subdivisions or reinstatement of the original title. The application for review or variation of the decree was therefore not merited and was dismissed.
