Ratio Decidendi

The court found that the dispute over ownership of the suit property, allegations of fraud, and the existence of conflicting titles and investigations by the Directorate of Criminal Investigation raised substantial and material issues of fact. These issues could not be adequately resolved by affidavit and written submissions alone. Rule 20 of the Mutunga Rules empowers the court to direct that a petition be heard by viva voce evidence where necessary. The court determined that justice required the parties and relevant witnesses to be cross-examined and for oral evidence to be adduced to clarify the contested facts.
