The delay was explained as being due to lack of notice and difficulty in accessing the court file to obtain proceedings. The respondent did not dispute that judgment was delivered in the absence of the applicants. The court was satisfied that sufficient cause for the delay was established and exercised its discretion to grant leave to appeal out of time. The court also found it necessary to maintain the status quo by granting a stay of execution, conditional upon the applicants depositing the judgment sum in an interest-earning account within 30 days.
