Procedural Posture

Civil Appeal / Appeal From Judgment of the High Court at Mombasa (hccc No 323 of 1987)

  1. 1 Whether the trial judge erred in fixing the date for conversion of damages in Italian Lira into Kenya Shillings as the date of the accident rather than the date of payment.
  2. 2 Whether the award of Kshs 250,000/- as general damages for personal injuries was inordinately low and thus erroneous.

Ratio Decidendi

The Court of Appeal found that the trial judge erred in fixing the date for conversion of Italian Lira to Kenya Shillings as the date of the accident, rather than the date of payment, contrary to established legal principles. The court also held that the award of Kshs 250,000/- as general damages was inordinately low, as the trial judge failed to consider the final medical report indicating the appellant would suffer permanent incapacity and recurrent pain. These omissions constituted misdirections justifying appellate interference. The court substituted the date of conversion to the date of payment and increased the general damages to Kshs 350,000/- to adequately compensate the appellant...
