Ratio Decidendi

The court found that the respondent only pleaded soft tissue injuries and did not specifically plead loss of pregnancy. The trial court erred by either being influenced by unpleaded claims or applying wrong principles in assessing damages. The appellate court held that damages must be based strictly on pleaded and proved injuries, and comparable cases for soft tissue injuries warranted a lower award. Consequently, the award of Ksh.400,000 was set aside and substituted with Ksh.150,000, less 20% contributory negligence, resulting in Ksh.120,000 as fair compensation for the injuries actually pleaded and proved.
