Ratio Decidendi

The court found that the Plaintiff had failed to take any steps to prosecute the suit since its filing in 1992, and had not provided any explanation for the delay. The grounds of opposition raised by the Plaintiff did not address the core issue of indolence or the lack of prosecution. The court held that litigation must come to an end and that the Plaintiff, having failed to act, must suffer the consequences of inaction. Accordingly, the application by the 8th Defendant was merited, and the suit against him was struck out for want of prosecution. The 8th Defendant was awarded costs.
