The suit was filed on 6th December 2005, well beyond the six-year limitation period prescribed for contract claims under section 4(1)(a) of the Limitation of Actions Act. The plaintiff's own advocates had previously acknowledged the claim was time barred. The plaintiff did not respond to the application to strike out the plaint. The court held that the suit was time barred, constituted an abuse of the court process, and that the application to strike out the plaint had merit. Consequently, the plaint was struck out and the defendant was awarded costs.
