The Plaintiff's claim of an oral agreement and reliance on previous dealings was unsupported by documentary evidence. The only reference to interest was in a letter from the Plaintiff, which was not responded to by the Defendant, and there was no evidence of prior transactions at the claimed rate. As such, the court held that no agreement on interest antecedent to the suit existed. In the absence of an agreed rate, Section 26(1) of the Civil Procedure Act applied, granting the court discretion to award interest...
