Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to File Reference Out of Time and Stay of Execution

  1. 1 Whether the court has jurisdiction to grant leave to file a reference out of time after judgment has been entered on a certificate of taxation.
  2. 2 Whether the applicant has provided sufficient reason for the delay in filing the reference against the Deputy Registrar's ruling.
  3. 3 Whether the court should stay execution of the decree pending determination of the application for leave.

Ratio Decidendi

The court held that it lacked jurisdiction to grant leave to file a reference out of time because it had already entered judgment on the certificate of taxation and issued a decree, rendering it functus officio. The discretion to enlarge time under paragraph 11(4) of the Advocates Remuneration Order is only available before judgment is entered. The applicant's reasons for delay were also found unpersuasive, as the ruling by the Deputy Registrar explicitly contained the reasons for taxation, and time began to run from the date of receipt of that ruling. The applicant's applications for leave and stay were therefore dismissed with costs, and the interim stay of execution was discharged.
