The court found that while there were grounds for disciplinary action against the Claimant, the Respondent failed to explicitly communicate the reasons for termination as required by Section 43 of the Employment Act. Furthermore, the disciplinary process did not comply with Section 41 of the Act, as the Claimant was not given a fair hearing or an opportunity to defend himself before the disciplinary committee. The Respondent's actions also contravened the principles of natural justice and Article 50(1) of the Constitution. As a result, the termination was declared unfair.
