Procedural Posture

Civil Suit / Ruling on Preliminary Objection and Interlocutory Injunction Application

  1. 1 Whether the Environment and Land Court has jurisdiction to hear the dispute in light of the Co-operative Societies Act.
  2. 2 Whether the Plaintiffs are entitled to injunctive relief and registration of a caveat over Nairobi/Block 82/8760.
  3. 3 Whether the Plaintiffs have demonstrated a prima facie case for the preservation of the Suit Property pending trial.

Ratio Decidendi

The court found that it had jurisdiction to hear and determine the dispute as it relates to title and occupation of land, which falls within the mandate of the Environment and Land Court under Article 162(2)(b) of the Constitution and Section 13 of the ELC Act. Court Disposition

Preliminary objection dismissed; status quo order granted; costs in the cause.
