The court found that the Applicant, as the son of the deceased and the closest next of kin, was the person entitled to apply for letters of administration. The Respondent, being a distant relative and not a beneficiary, had no legal basis to substitute himself as petitioner. The process by which the Applicant's name was deleted and replaced with the Respondent's was irregular and amounted to a strong ground for revocation. The court declined to determine the issue of trusteeship, holding that such matters are for a different forum. The grant was therefore revoked due to procedural impropriety and lack of entitlement on the part of the Respondent.
