By operation of law, specifically section 85A(1)(a) of the Elections Act and the relevant Court of Appeal Rules, the notice of appeal was deemed withdrawn. The subsequent attempt to withdraw the notice of appeal was ineffective as it was already deemed withdrawn by operation of law.
