Miscellaneous Criminal Application / Ruling on Application for Transfer of Criminal Case

  1. 1 Whether the applicant is unlikely to get justice if tried in Embu court station in Criminal Case No. 435 of 2017.
  2. 2 Whether the applicant has established grounds for transfer of the criminal case to another court outside Embu.

Ratio Decidendi

The court found that the applicant failed to demonstrate any real likelihood of bias or injustice if his case proceeded in Embu. The applicant did not provide evidence that the trial magistrate was biased or that the presence of court staff as witnesses would compromise the fairness of the trial. The High Court's revision and order for a fresh trial were lawful and did not amount to double jeopardy. The bond terms were not excessive and had already been reviewed downward. The application did not meet the threshold under Section 81 of the Criminal Procedure Code for transfer of the case, as the applicant did not establish that a fair and impartial trial could not be had in Embu....
