Ratio Decidendi

The court found that the suit land is still within an adjudication section and that there was no evidence the adjudication register had become final as required by law. Section 30(1) of the Land Adjudication Act expressly bars the institution and entertainment of civil proceedings regarding land in an adjudication section until the register is finalized. Since this statutory requirement had not been met, the court lacked jurisdiction to entertain the suit. The suit was therefore improperly before the court and had to be struck out regardless of the substantive claims of fraud or ownership.
