Civil Appeal / Ruling on Jurisdiction

  1. 1 Whether the court has jurisdiction to hear an appeal where the Appeals Committee has not rendered a decision.
  2. 2 Whether an appeal can be properly filed in the absence of a final decision from the Appeals Committee.

Ratio Decidendi

The court held that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Under the Land Disputes Tribunals Act, appeals to the court can only be made against decisions of the Appeals Committee. Since no such decision existed, there was no valid appeal before the court. The court emphasized that jurisdiction is fundamental and must be addressed at the earliest opportunity. Entertaining the matter would amount to acting without jurisdiction, rendering any proceedings a nullity. Consequently, the court ordered that the file be removed from the list of pending appeals and declared the matter disposed of.

Court Disposition

Appeal struck out for want of jurisdiction.
