Ratio Decidendi

The Tribunal found that although service may not have been properly effected, the Defendant was aware of the proceedings and chose not to participate. The Defendant did not dispute the debt or the figures and admitted to owing the amount claimed. Given the age of the debt and the lack of a prima facie defence, the Tribunal held that it would not be just or equitable to set aside the judgment. However, considering the Defendant's medical condition and partial payments made, the Tribunal exercised its discretion to stay the warrant of arrest for three months and allowed the decretal sum to be paid in installments over six months, with execution to issue in default of payment.
