Ratio Decidendi

The court held that it lacked jurisdiction to grant a stay of execution in respect of decrees issued by another court, as the application was not brought before the court that issued the decree or the court to which the decree was sent for execution. The applicant had not preferred any appeal to bring the matter within the appellate jurisdiction of this court. The relevant provisions of the Civil Procedure Rules clearly stipulate the proper forum for such applications. The applicant failed to explain why the application was filed in this court contrary to the law. Consequently, the application was found to be improperly before the court and was struck out with costs to the respondents.
