Procedural Posture

Employment Cause / Ruling on Application to Reopen Hearing

  1. 1 Whether the respondent was properly served with a hearing notice for the hearing on 15th May, 2018.
  2. 2 Whether proceedings conducted in the absence of the respondent should be set aside and the case reopened.
  3. 3 Whether setting aside the proceedings would prejudice the claimant.

Ratio Decidendi

The court found that the respondent was not properly served with a hearing notice for the hearing on 15th May, 2018. The affidavit of service referred to a hearing notice for 15th March, 2018, a date when the court was not sitting. There was no evidence that the respondent was notified of the actual hearing date. Proceeding in the respondent's absence under these circumstances would be prejudicial and result in a miscarriage of justice. Therefore, the proceedings of 15th May, 2018 were set aside and the hearing ordered to commence afresh to ensure fairness and uphold the right to be heard.
