The court found that although the law prescribes a minimum sentence of 20 years for defilement of a child aged between twelve and fifteen, the Supreme Court's decision in Muruatetu allows for judicial discretion in sentencing. The appellant, being a relative and significantly older than the complainant, abused the trust placed in him and attempted to conceal his actions by eloping with the minor. These were aggravating factors justifying a stringent sentence. However, the appellant's remorse and other mitigating circumstances warranted a reduction of the sentence below the statutory minimum.
