Ratio Decidendi

The court found that the Plaintiffs and their predecessors had been in continuous occupation and possession of Kilifi/Vyumbani/92 since at least 1947, and that the 1st Defendant fraudulently registered the land in his name during the adjudication process by misusing the 1st Plaintiff's identity card. The Bahari Land Dispute Tribunal had already determined the registration was based on false information, and the Defendants did not appeal or contest this finding. The Defendants failed to enter appearance or adduce any evidence to rebut the Plaintiffs' claims. On the evidence, the court held that the 1st Defendant could only have been registered as proprietor as a trustee for the Plaintiffs....
