Ratio Decidendi

The court found that the Deputy Registrar erred in issuing warrants of arrest and committal orders against the applicants without first being satisfied that the decree-holder had discharged the burden of proof that the applicants had the means to pay the decretal sum or a substantial part thereof and had refused or neglected to do so. The only evidence before the court was that the applicants received KES 25,000 per month from rental income, which was not controverted by the decree-holder. The court held that the requirements of Section 38 of the Civil Procedure Act and Order 22 rule 35 of the Civil Procedure Rules were not met, and therefore the warrants of arrest and committal orders...
