Ratio Decidendi

The court found that both parties accused each other of cruelty and desertion, and the evidence demonstrated mutual emotional distress and lack of spousal care. The court was satisfied that the marriage had irretrievably broken down, with no possibility of reconciliation, as both parties wished to move on with their lives. The grounds of cruelty and desertion were established by the evidence, and the legal requirements for dissolution under Section 8 of the Matrimonial Causes Act were met. The court therefore ordered the dissolution of the marriage, issuing a decree nisi to be made absolute within 30 days, and directed that each party bear its own costs.
