The applicant raised triable issues in the memorandum of appeal, and the risk of substantial loss was considered, particularly as the respondents did not oppose the application. The court held that the interests of justice required a stay of execution, provided the applicant deposited the full decretal sum into a joint interest-earning account in the names of both advocates within twenty-one days.
