Ratio Decidendi

The court held that the application for substitution and revival of the suit was incompetent because the suit had abated by operation of law one year after the claimant's death, and the applicant had not sought extension of time as required under Order 24 Rule 3(2) of the Civil Procedure Rules. Without an application for extension of time, the court could not entertain the application for substitution or revival. The sequence prescribed by the rules must be strictly followed, and the applicant's failure to first seek extension of time was fatal to the application.
