Procedural Posture

Stay Application / Ruling on Application for Stay of Execution and Leave to Appeal

  1. 1 Whether the High Court should grant a stay of execution of its ruling revoking the grant and land titles pending appeal.
  2. 2 Whether leave to appeal against the ruling of the High Court in a succession cause should be granted.
  3. 3 Whether the High Court has jurisdiction to revoke title to land acquired through succession.

Ratio Decidendi

The court declined to render a merit ruling on the application for stay of execution and leave to appeal because the impugned ruling was delivered by a different judge (M. S. Shariff, J.), who remains at the station and has not recused herself. The matter was placed before the present judge due to an administrative error. The judge held that, in good conscience and in the interest of proper judicial process, she ought not to have heard or determined the application. The file was directed to be placed before the original judge for directions on the hearing and determination of the application.

Court Disposition

No merit ruling rendered; file to be placed before original judge for directions.
