Procedural Posture

Constitutional Petition / Judgment

  1. 1 Whether the petitioner had locus standi to institute the petition on behalf of the substantive Chief Land Registrar.
  2. 2 Whether the appointment of the 5th respondent as Acting Chief Land Registrar was unconstitutional and unlawful while there was a substantive office holder.
  3. 3 Whether the respondents interfered with the employment and discharge of duties by the substantive Chief Land Registrar.

Ratio Decidendi

The court found that the petitioner lacked locus standi to institute the petition on behalf of the substantive Chief Land Registrar, as he was neither an employee of the respondents nor authorized by the office holder to act on her behalf. The petitioner failed to provide any appointment letter or other evidence to prove that the 5th respondent had been appointed as Acting Chief Land Registrar. The court held that the allegations of interference and frustration were unsupported by evidence. In the absence of proof of the alleged appointment or constitutional violations, the petition was found to lack merit and was dismissed in its entirety. The court made no order as to costs.
