The High Court found that the trial court erred in dismissing the appellant's suit on the basis of res sub-judice. Upon reviewing the pleadings, the appellate court determined that the subject matter of the lower court suit (removal of metal barriers blocking access to the appellant's shop) was distinct from the subject matter of the pending High Court suits (payment of Cess tax). The court held that the doctrine of res sub-judice under Section 6 of the Civil Procedure Act only applies where the issues in both suits are directly and substantially the same, which was not the case here.
