Ratio Decidendi

The High Court found that the trial magistrate's apportionment of liability at 50:50 was not supported by evidence or law. The respondent's negligent overtaking maneuver was the sole cause of the accident, as the appellant was in his rightful lane and there was no evidence he failed to maintain a safe distance or otherwise contributed to the accident. The deduction of special damages by 50% was also erroneous, as these had been specifically pleaded and proved. The court set aside the lower court's judgment, re-apportioned liability at 80:20 in favour of the appellant, awarded general damages less 20% liability, awarded full special damages, and granted costs and interest to the appellant.
