The tribunal found that despite the expiry of the written sublease, the landlord's continued acceptance of rent from the tenants created a controlled periodic tenancy under the Land Act and Cap 301. The tribunal therefore retained jurisdiction over the dispute. The landlord's attempt to increase rent was invalid as no statutory notice was issued, and the rent payable remained at Kshs. 35,000 for the relevant period. The tenants were not in arrears, having paid as ordered. The landlord's conduct in failing to respond to the tenants' request to renew the lease, then issuing an eviction notice, was found to be unfair.
