Ratio Decidendi

The court found that the applicant had served the bill of costs on the respondent on 22nd September 2017, and the bill was not settled within the stipulated time. Rule 7 of the Advocates Remuneration Order entitles the advocate to charge interest at 14% per annum from one month after delivery of the bill of costs, provided the claim for interest is made before payment. There is no requirement for the certificate of taxation to be served before interest accrues. The respondent's objection based on lack of service of the certificate of taxation was therefore without merit.
