The court held that it was functus officio, having already delivered its judgment on 11th April 2024, and that the matter was now the subject of an appeal in the Court of Appeal. As such, there was no suit pending before the Environment and Land Court, and it lacked jurisdiction to entertain the application for joinder or to set aside the judgment. The proper forum for the Interested Party/Applicant to seek joinder or any other relief was in the appellate court where the appeal was pending. The preliminary objection raised by the Plaintiffs/Respondents was upheld, and the Notice of Motion dated 9th December 2024 was dismissed with costs to the Plaintiffs.
