Ratio Decidendi

The High Court lacks jurisdiction to entertain a revision application for review of bond terms where the applicant had the right to appeal the initial review decision but failed to do so. Section 364(5) of the Criminal Procedure Code expressly prohibits revision proceedings at the instance of a party who could have appealed. The applicant, having already benefited from a downward review of bond and having failed to appeal the subsequent decision, cannot invoke the High Court's revisionary jurisdiction to seek a further reduction. The application is therefore incompetent and must be dismissed for want of jurisdiction.
