Ratio Decidendi

The court held that although the respondent had some basis to consider disciplinary action against the claimant for prior misconduct, it failed to prove that she absconded duty after 19th January 2022 and, in any event, it did not subject her to the required disciplinary process before terminating her employment. The termination was therefore unfair and wrongful. Compensation was reduced because the claimant's own conduct had contributed to the strained employment relationship.
