The Tribunal found that the landlord and agent levied distress for rent and confiscated the tenant's motorcycle without first obtaining the Tribunal's consent, as required under Section 12(1)(h) of Cap. 301. This rendered the distress illegal. The Tribunal further held that, while the tenant admitted to being in rent arrears, he had offered to pay the arrears by instalments, and the landlord did not oppose this arrangement. The Tribunal exercised its statutory powers to restrain further attachment of the tenant's property, ordered the tenant to pay current rent and additional monthly instalments towards arrears, and clarified that only upon default could the landlord levy distress without...

  • The tenant shall pay rent to the landlord as it falls due and, from November, shall pay an additional sum of Kshs. 25,000 monthly to offset outstanding rent arrears. In default, the landlord will be at liberty to levy distress without reference to the Tribunal.
