The court found that the preliminary objection based on res judicata was unmerited because an application for stay of execution is expressly permitted to be made both in the trial court and, if unsuccessful, in the appellate court under Order 42 rule 6(1) of the Civil Procedure Rules. The doctrine of res judicata does not bar such applications, as the appellate court is empowered to consider them afresh.
