Procedural Posture

Stay Application / Ruling on Interlocutory Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the Respondent has established sufficient grounds for stay of proceedings pending the determination of an intended appeal.
  2. 2 Whether the Respondent has demonstrated the existence of a pending appeal relevant to this Petition.
  3. 3 Whether the application for stay was brought expeditiously and in good faith.

Ratio Decidendi

The Court found that the Respondent failed to demonstrate the existence of a pending appeal, as the assertion by the Petitioner that no appeal had been filed was left unchallenged. The application for stay was not brought expeditiously, having been filed only a day before the scheduled hearing and after the Respondent had caused multiple adjournments and failed to pay costs. The Court noted that the Respondent had ample opportunity to seek consolidation or stay earlier but did not do so. Given these circumstances, the Respondent did not meet the high threshold required for a stay of proceedings, and the application was declined with costs to the Petitioner.

Court Disposition

Application for stay of proceedings declined with costs to the Petitioner.

Orders
