The Tribunal found that the Respondent was personally served with Summons to enter Appearance, making the default judgment regular. The Tribunal then examined the draft Defence and determined that it raised triable issues, specifically the denial of default in loan repayment and the assertion of payment of Kshs.95,800/=. The Tribunal held that these issues could only be determined at trial upon adducing evidence. Consequently, the Tribunal exercised its discretion to set aside the default judgment and granted the Respondent leave to file a Defence, in the interest of justice.
