Ratio Decidendi

The court found that both the tenants' and landlord's notices to terminate the tenancy did not comply with the mandatory requirements of section 4 of Cap 301, as neither notice was in the prescribed form nor provided the requisite two months' notice. The landlord's notice was also issued during the pendency of the suit, rendering it invalid. Consequently, the tenancy relationship between the parties was not legally terminated and remains in force until properly terminated in accordance with the law. The landlord is restrained from interfering with the tenants' possession, but retains the right to issue a fresh, compliant notice if desired.
