The Tribunal found that it has jurisdiction to vary or rescind its own orders under Section 12(i) of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The landlords admitted to being served but attributed their non-attendance to a mistake by their legal officer in failing to instruct counsel. While such mistakes are not always excusable, the Tribunal considered that the application for review was filed promptly and that mistakes can occur. In the interest of justice, and considering the timely filing, the Tribunal exercised its discretion to allow the landlords' application to set aside the ex parte orders, subject to the tenant being awarded throw away costs...
