Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimants’ employment contracts were unfairly terminated.
  2. 2 Whether the claimants are entitled to compensation for unfair termination, redundancy pay, salary in lieu of notice, and refund of unremitted NSSF contributions.

Ratio Decidendi

The court found that the claimants failed to provide evidence that their fixed term contracts were terminated prematurely or that they continued working after the lapse of their contracts. There was no proof that the contracts had been converted to unlimited term contracts. The respondent's position that the contracts ended by effluxion of time was accepted. Consequently, the claims for unfair termination, redundancy pay, salary in lieu of notice, and refund of unremitted NSSF contributions were dismissed. The only award was the aggregate sum agreed by the parties for other terminal benefits.

Court Disposition

Claim dismissed except for agreed sum; partial costs and interest awarded to claimants.

Orders

  • The suit is dismissed save for the award of the aggregate sum of Kshs.677,279 agreed by the parties on 5.2.2016.
  • The claimants will have half costs of the suit plus interest.
